All fees and charges that we apply adhere to the fee scales set out in the current regulations governing enforcement, namely The Taking Control of Goods (Fees) Regulations (as amended), which were last updated with effect from 1st May 2026.
Below we have listed the fees that will be added to your account, in the order in which they will be applied, at each stage of the recovery process. This fee structure is applicable to debts such as council tax arrears, business rates arrears, and road traffic debts where the local authority has obtained a Liability Order/Warrant against you and has sent it to Hambury Tilmond to be enforced.
£79.00 will be automatically added to your account as soon as we receive the instruction from the local authority to enforce the Liability Order/Warrant against you. The fee is not dependant on us sending, or you receiving, the Notice of Enforcement. This charge is ‘per account’ so if we receive two instructions for you at the same time then two separate £79.00 fees will be applicable. Once the Notice of Enforcement is sent, we give you at least 14 working days (7 days for business rate debts) from the date on the Notice to make payment, before your account is passed to an Enforcement Agent for enforcement. An Enforcement Agent will not visit your property if you make payment in full or set up and adhere to a payment arrangement with us within this timeframe.
£247.00 is added to your account the moment the Enforcement Agent visits your property for the purposes of taking control of your goods. For larger balances (debts over £1,900) or multiple cases please note an additional fee of 7.5% of the total debt over £1,900 is charged on top of the £247.00. This enforcement stage fee covers all debts in the same name which are able to be enforced at the same time.
Your account will be passed to an Enforcement Agent if you fail to contact us with an acceptable payment arrangement or make payment in full during the compliance stage or if you missed a payment that was agreed as part of your arrangement.
Once an Enforcement Agent visits you, you will have accumulated at least £326.00 of fees on your single account (£79.00 + £247.00). The Enforcement Fee will only be added to your account once and not every time an Enforcement Agent visits you for the same case.
£116.00 will be added to your account if you fail to pay your debt or if you default on your arrangement and an Enforcement Agent visits your property for the purposes of removing your goods. For larger balances and multiple cases an additional fee of 7.5% of the total debt over £1,900 is charged on top of the £116.00. At this stage you will have had at least £442.00 added to the amount you owe. (£79.00 + £247.00 + £116.00).
